Terms of Use
Last updated: September 28, 2026
These terms govern your use of Acoustic Beacon's website, consumer service and merchant platform. By using the service, you agree to these terms. If you do not agree, do not use it. “Acoustic Beacon” refers to the service operator; these terms do not assert a separate incorporated legal entity. Our Privacy Policy explains information handling.
The service and consumer use
Acoustic Beacon connects compatible acoustic signals to participating content and offers. Detection depends on compatible devices, permissions, connectivity and surrounding conditions. The consumer apps are coming soon and pre-release behavior may change. A detected beacon displays content in the app; it does not authorize a purchase or external action. You choose whether to open external links or act on an offer. Do not rely on this service for emergency or safety-critical information.
Merchant accounts
You must be at least 18 and authorized to represent the business when creating a merchant account. Provide accurate account information, protect your credentials and tell us if you suspect unauthorized access. Public registration creates a Merchant account, not a Manager account. You are responsible for activity you authorize through your account. Access is limited to resources you are permitted to manage.
Offers and merchant responsibility
Merchants are responsible for their promotions, content, pricing, taxes, eligibility requirements, expiration dates, stock or service availability, redemption conditions and compliance with applicable law. They must have rights to submitted material and keep offer details accurate. Acoustic Beacon does not guarantee that an offer will remain available or that a merchant will fulfill it. Check current conditions with the merchant before acting. Any transaction with a merchant is between you and that merchant; the current platform does not process payments.
Prohibited use and content
Do not misuse accounts, bypass access controls, interfere with service operation, distribute malware, impersonate others, harvest private information, spam, or use the service for fraud or unlawful purposes. Do not submit deceptive, infringing, threatening, unlawfully discriminatory or otherwise unlawful content. Do not assign beacons or manage campaigns without authorization, or use signals to misrepresent another source.
Intellectual property
Acoustic Beacon branding, software and original service materials belong to their respective rights holders. These terms grant only the limited right to use the service as intended, not ownership. Merchants retain rights to their content and grant Acoustic Beacon a non-exclusive permission to host, reproduce, format and display that content as necessary to provide the service, including authorized public offers and opted-in listings. Third-party trademarks remain their owners' property; their appearance does not imply endorsement.
Suspension, termination, and changes
We may restrict or suspend access or remove content reasonably necessary to address misuse, security risks, legal requirements or violations of these terms. Where practical and legally appropriate, we will provide notice and an opportunity to address the issue. You may stop using the service and request merchant account deletion through Privacy Choices. Some records may be retained as explained in the Privacy Policy.
We may maintain, modify or discontinue features. We do not promise uninterrupted availability, error-free operation or continued availability of pre-release features. Where required by law, we will provide notice of material changes. The public demo is illustrative and uses fictional data; it does not create a live merchant account or offer entitlement.
Disclaimers and liability
To the extent permitted by law, the service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee detection accuracy, merchant content, savings or commercial results.
To the extent permitted by law, Acoustic Beacon is not liable for indirect, incidental, special or consequential losses, including lost profits or data, arising from use of the service. For other claims, our aggregate liability is limited to the greater of US $100 or the amount you paid Acoustic Beacon for the affected service during the preceding 12 months. These limits do not exclude liability for fraud, willful misconduct, gross negligence, or any liability or consumer right that cannot legally be limited. Some jurisdictions do not allow these exclusions, so they apply only as permitted.
Governing law and disputes
Kentucky law governs these terms, without its conflict-of-law rules, except where mandatory law provides otherwise. Disputes may be brought in a state or federal court in Kentucky with jurisdiction, subject to any non-waivable right you have to use another forum. Nothing here requires arbitration or waives mandatory consumer protections. Please first contact us to try to resolve a concern informally.
Updates and contact
We may revise these terms and update the date above. We will provide notice of material changes where required; continued use after an effective change means acceptance to the extent permitted by law. Questions can be sent through the Acoustic Beacon Contact page.
